Sometimes the Treatment for an Oklahoma DUI Conviction Can Seem Like Punishment Itself- Oklahoma DUI Defense

Conviction based on a violation of Oklahoma’s DUI laws carries with it a number of penalties, which vary in severity based on factors such as whether the conviction is for a first-time or subsequent offense or the degree of intoxication. Penalties can include sanctions like fines, community service, jail time, or the requirement to have an ignition interlock device installed in his or her vehicle. One additional consequence of an Oklahoma DUI conviction, receiving a deferred sentence, or losing your Oklahoma driver’s license that may not be as well-known as the penalties mentioned above is the requirement to participate in an alcohol and drug substance evaluation and assessment program. Unlike a term in jail or a monetary penalty, this requirement is not necessarily intended to be a form of punishment as much as a form of treatment. But as we will see on closer examination, sometimes when the criminal justice system seeks to help you the experience can feel like something else entirely.

As a starting point, any alcohol and drug assessment must be performed by persons and organizations that are officially certified to perform them. This certification requires whomever administers the assessment to comply with a multitude of regulatory requirements which can quickly become burdensome and intrusive to the person being evaluated. As an example of this, consider the Alcohol and Drug Substance Abuse Course (ADSAC) participant evaluation, which consists of:

A formal intake interview performed in a clinical setting. Here, you will be required to provide socio-demographic information about yourself as well as answer questions about your personal history. You will also need to complete an Addiction Severity Index, which will be scored.The evaluation will also delve into your driving record, your history of alcohol and drug use, past treatment, and past drug-related arrests.

That may sound tedious to have to undergo, but it is only the beginning. You will also be subject to a “biopsychsocial assessment,” an Orwellian-sounding name for a formal interview that will go into even more minute details of your personal life. The assessor will seek to uncover your medical conditions, your family and social history, your cultural and religious orientations, your marriage history and your living arrangements, your finances, your school background, your health history, any mental health treatments you may have had, even your recreational and leisure time preferences.

This psychological and inquisitory stripping-down of your personal privacy is meant to “help” you, and will be the foundation to determine what kind of specific treatment courses and programs that you will be required to undergo. But you may be excused for being reluctant to undergo such an intimate form of assistance. If you are required to go through one, we have assessors that will treat you with respect for your privacy.

There is no way to get around going through the ADSAC if you have been convicted of an Oklahoma DUI offense or lose your Oklahoma driver’s license.  The only way to avoid it is to not be convicted if you stand accused of such an offense. March 07, 2015 What's the very minimum treatment requirement on my DUI case?The very minimum alcohol/drug treatment required in every DUI case - whether reduced/amended or not - is the 8-hour alcohol drug information school (ADIS) and the 1-2 hour DUI Victim's panel. An alcohol/drug evaluation is also required with every DUI case.

Giving Cops “The Silent Treatment” at DUI Checkpoints

635592639028572434-AP-DUI-Checkpoint-ChallengesAn attorney in Florida has recently proposed a tactic that drivers can use to avoid questioning at a DUI checkpoint.  Boca Raton attorney Warren Redlich suggests using a sign like the one he is holding. He has made a YouTube video, which has gone viral, showing how it works .

But could this method work in Pennsylvania?  CBS 21 Harrisburg recently asked Attorney Richard Roberts of The McShane Firm:

HARRISBURG, Pa.– A Florida attorney got national attention after he tried going through a DUI checkpoint without saying a word. That attorney said all a driver needs to do is show the officer a sign and a license through a closed window.  But is this method acceptable in Pennsylvania?

Video of a DUI checkpoint in Florida last New Year’s Eve went viral. In the video police wave a driver through without asking him to roll down his window.  One may wonder if someone can actually get away with that?

The man behind the wheel in the video is Florida Attorney Warren Redlich. He says this is a way to protect a driver’s rights at a DUI checkpoint; it’s not however, designed to allow drunk drivers through the checkpoints.

Michelle Haselrig of Harrisburg doesn’t agree with this tactic one iota.

“That would hurt somebody; get into a car accident when they could have stopped them. I don’t think people should start doing this at all. Just go through the checkpoints,” Haselrig said.

How feasible is this method in Pennsylvania?  Harrisburg DUI attorney Richard Roberts has the answers.

“Simply because you refuse to roll down your window, simply because you refuse to speak to the officer does not give them grounds to stop you,” Roberts said.

It is by rights that one can keep their window up at a check point as long as you provide a visible license and registration, but it’s not advised.

“You are drawing attention to yourself, so you understood that anytime you assert your rights there are probably some risks with people who think you’re doing the wrong thing,” Roberts said.

Studies have found that DUI checkpoints reduced alcohol related crashes by about nine percent.

Obama’s Uncle Gets the Royal Treatment

And I thought only cops and judges got special handling when they drive drunk….


On the Road Again: Obama’s ‘Drunk Driving’ and Illegal Immigrant Uncle Allowed to Drive Again After Hardship License is Approved 

Boston, MA.  April 3 –Just a week after President Obama’s uncle pleaded guilty to drunk driving and surrendered his driver’s licence, he’s back behind the wheel.

Onyango Obama, 67, was approved for a ‘hardship licence’ yesterday, which allows him to drive in Massachusetts from noon to midnight.

The Boston Herald reported that Obama, the half brother of the president’s father, convinced a Registry of Motor Vehicles panel that an inability to drive would adversely affect his job as a liquor store manager.

And, despite his status as an illegal immigrant, his request was approved…

Obama, of Kenya, is also appealing a deportation order that dates to 1992, when he failed to renew his application to remain in the U.S.

The drunken driving charge will be dismissed if he stays out of trouble for a year, officials said.

Obama was arrested in Framingham in August after a police officer said he made a rolling stop at a stop sign and nearly caused the officer’s cruiser to crash into his sport utility vehicle.  Once pulled over, the DA said Obama’s speech was slurred, ‘his eyes were red and glassy and there was an odor of alcohol coming from inside the motor vehicle.’

Obama then failed several field sobriety tests and his blood alcohol was almost twice over the legal limit, reports the Herald.


It must be nice to be the uncle of the President….
